Claims, Insurance and Risk Management

If you believe Haldimand County may be responsible for costs or damages you have incurred, submit a claim to have your situation reviewed.

Claim types

Before you make a claim

Before submitting a claim to Haldimand County for loss or damage, please note the following considerations:

  • Always call your insurance broker first. They can guide you through your insurance policies and respective coverages.
  • Investigating claims takes time. If repairs or replacements are needed immediately, it may be quicker to work through your private insurance.
  • Depending on your coverage, your insurance may provide full replacement value. Haldimand County can only compensate based on the established depreciated value of the loss.
  • Haldimand County is not responsible for any costs you incur during the claims process unless it is determined that our negligence led to the loss.
  • The responsibility to prove negligence on behalf of Haldimand County rests with the Claimant.

Claims process

Once a claim has been received by Haldimand County:

  • Claims are reviewed to determine who has custody of the loss location – another party, a contractor or Haldimand County. If the jurisdiction falls to another party (i.e., the MTO on Highway 6), you will be notified. If jurisdiction falls to that of a contractor, the process will follow the Contractor Claims Process.
  • An independent Claims Adjuster may be assigned.
  • You will be issued an acknowledgement of receipt of the claim by Haldimand County, a contractor or an independent adjuster.
  • If acknowledged by Haldimand County or an independent adjuster, a claim number will be assigned. Please reference this number anytime you are inquiring about the matter.
  • An investigation will commence which may include seeking more information from you by email, phone, or in person. The purpose of the investigation is to confirm whether Haldimand County would be legally liable for the incident.
  • The estimated timeline for an investigation is 6 to 12 weeks depending on the complexity of the claim and your claim's place in the queue.
  • If it is determined that Haldimand County is legally liable, negotiations of settlement will commence, an offer of settlement will be issued and you’ll be required to sign a Full and Final Release.
  • If it is determined that Haldimand County was not negligent, the claim is denied along with an explanation of the reason for denial.
  • If you are not satisfied, your next steps would be to look at proceeding with legal action against Haldimand County.

To commence legal action, a Statement of Claim submission must comply with the legislated process. This requires that court documents are to be served to the Municipal Clerk or delegate of Haldimand County.

Only the serving of official documents to the Clerk or designate can commence a claim in Court. Previous Haldimand County claim submissions or correspondence are not sufficient.

Where Haldimand County has determined it is not liable, it will vigorously defend any legal claim against it. We do not pay “nuisance settlements” to avoid going to Court.
