The Opportunity

This role drives efficient case management across municipal by-laws and provincial and federal statutes, supports civil enforcement actions, and contributes to internal legal policy development to reduce reliance on external counsel. By promoting consistency, transparency, and compliance with the Memorandum of Understanding with the Ministry of the Attorney General, the Supervisor plays a key role in strengthening public confidence in the administration of justice.

Position Summary
The Supervisor, Provincial Offences Administration and Prosecution is responsible for supervising the day to day operations of POA (excluding collections) and prosecuting offences under Parts I, II, and III of the Provincial Offences Act (POA), representing Haldimand County in court, conducting Early Resolution meetings, managing disclosure, and conducting trials in accordance with legal standards and procedural fairness. The role ensures efficient case management across a broad range of POA matters, including municipal by-laws, provincial and federal statutes. It also supports civil enforcement actions and contributes to internal legal policy development, helping reduce reliance on external legal counsel for prosecutions. By promoting consistency and transparency in the legal processes, the Supervisor strengthens public confidence in the administration of justice in compliance with the Memorandum of Understanding with the Ministry of Attorney General.
Qualifications, Knowledge, and Skills
Education
- Completed a minimum of a two-year college degree in Paralegal Studies, Public Administration, Law or directly related field.
- A bachelor’s degree in law, Criminology, Justice Studies, or a related discipline is preferred.
Experience
- 2 years’ experience in a legal or regulatory environment, preferably involving court procedures or administrative tribunals with exposure to Provincial Offences matters through education, internship, or junior legal roles.
- 3–5 years of direct experience prosecuting POA matters, municipal by-law infractions, or regulatory offences with experience conducting trials, early resolution meetings, and appeals in the Ontario Court of Justice.
- Candidates must have a minimum three (3) years’ municipal or relevant experience including 2 years’ experience related to the preparation of court documents and witnesses, and attendance at provincial court matters and/or tribunal matters with demonstrated knowledge of the Provincial Offences Act and legal system.
- Licensed paralegal in good standing with the Law Society of Ontario.
- Bilingual in French would be considered an asset.
- Experience with a municipal Administrative Monetary Penalty System is preferred.
Knowledge/Skills
- Working knowledge of the Provincial Offences Act, relevant case law, disclosure, and Early Resolution.
- Excellent advocacy, negotiation, and legal research skills.
- Working knowledge of relevant Federal and Provincial statutes and regulations, municipal by-laws applicable to Provincial and Municipal offences and Charter of Rights and procedures relating to Charter issues.
- Knowledge of and ability to abide by Provincial Standards and Guidelines for Prosecutors, in accordance with the Memorandum of Understanding (MOU) between the Province and Haldimand County.
- Ability to manage multiple files and meet deadlines.
- Excellent verbal and written communication skills with the ability to communicate strategically and provide resolutions if necessary to handle significant contacts with long-term impacts.
- Demonstrated initiative, and ability to make decisions involving routine tasks, within established procedures.
- Demonstrated ability to work independently referring only to major problems to supervisors/managers.
- Demonstrated ability to exercise significant discretion and sensitivity involving regular work with confidential information.

- In depth knowledge of:
- POA Parts I, II, and III
- Ontario Evidence Act
- Charter of Rights and Freedoms, and relevant case law.
- Courtroom advocacy, including examination and cross-examination of witnesses.
- Ministry directives, policies, and ethical standards for prosecution.
- Technology Aptitude
- Demonstrated intermediate computer skills to utilize various technological devices and programs while adhering to cybersecurity and best practices are followed.
- Intermediate knowledge of MS Office (Word, Excel, Outlook, PowerPoint)
Responsibilities
The incumbent is responsible for, but not limited to:
Corporate
- Contributes to the development and implementation of internal legal policies, procedures, and protocols related to prosecutions and enforcement.
- Maintain accurate records of prosecutions, resolutions, and enforcement actions to support internal reporting and performance tracking.
- Ensure prosecutorial activities comply with the Memorandum of Understanding with the Ministry of the Attorney General and applicable legislation.
- Aid in the development and implementation of process improvements to streamline workflows, enhance efficiency and support consistent service delivery.
People
- Supervises the day-to-day operations including POA staff scheduling and providing direction on ensuring POA matters are addressed accurately, efficiently and in compliance with legislative requirements and organizational standards.
- Conduct Early Resolution meetings and engage with defendants, legal representatives, and members of the public in a professional and impartial manner.
- Collaborate with internal POA team to ensure consistent application of legislation and legal procedures.
- Lead or participate in training or mentoring initiatives for staff involved in POA enforcement and prosecution processes.
- Foster respectful and effective communication across departments and with external agencies to support legal compliance and service excellence.
Timeline
- Administer disclosure, case preparation, and tracking to ensure compliance with prescribed timelines and service standards, including limitation periods and Jordan ceiling considerations.
- Collaborate with POA staff to coordinate Early Resolution meetings and trial scheduling to support timely case resolution.
- Support civil enforcement by meeting legal and administrative timeframes.
Money/Asset
- Support the recovery of outstanding fines and penalties through civil enforcement and legal strategy.
- Ensure accurate and timely processing of court documentation to avoid delays in financial penalty collection.
- Contribute to cost-effective legal operations by streamlining case management and resolution processes.
- Maintain secure handling and storage of sensitive legal documents and evidence in accordance with applicable policies.
Functional
- Prepare and present cases as the prosecutor in POA court under Parts I, II, and III, including reviewing evidence, interviewing witnesses, and researching relevant case law.
- Conduct Early Resolution meetings, pre-trial conferences, and participate in disclosure processes to support timely and fair case resolution.
- Represent Haldimand in the Ontario Court of Justice and Small Claims Court to aid in the facilitation process of civil enforcement actions such as wage garnishments and fine recovery.
- Provide legal guidance to enforcement officers and other County staff on POA matters, offence notices, and information preparation.
- Conduct appeals and reviews of dismissed or quashed matters, and perform other legal duties as assigned, including appearances before courts and tribunals.
- Other duties as assigned.
